ESMA Clarifies MiCA Rules on Euro Balances Held at Crypto Exchanges
ESMA's MiCA Q&A item 70 clarifies how euro balances on crypto exchanges must be structured, pointing fiat handling toward payment-services licensing.

The European Securities and Markets Authority (ESMA) has published guidance on how euro balances held by clients on crypto exchanges should be treated under the EU's Markets in Crypto-Assets Regulation (MiCA), addressing the question in item 70 of its MiCA Q&A series.
The clarification concerns a structural question for trading platforms operating in the European Union: whether a crypto exchange that lets customers hold fiat euro balances on-platform is conducting an activity that falls outside MiCA's own perimeter and into adjacent regulated payment services. The answer determines which authorization an exchange needs, not merely how it labels a product feature.
Why does a euro balance raise a licensing question?
MiCA, which entered into force in 2023 and became applicable to crypto-asset service providers across the EU in December 2024, regulates crypto-asset services such as custody, exchange and execution. Fiat currency itself is not a crypto-asset, so a euro balance sitting on an exchange is not covered by MiCA as a crypto-asset service in its own right.
That leaves platforms with two options under EU law. Either they keep client euros with a regulated payment or e-money institution and route flows through that licensed counterparty, or they obtain the relevant payment-services authorization themselves. The Q&A item addresses how these arrangements must be structured so that the fiat leg of a crypto trading account complies with the applicable payment framework rather than with MiCA alone.
For exchanges, the operational consequence is concrete. A platform that offers seamless euro funding, euro-denominated account statements or instant euro withdrawals is providing payment functionality, and that functionality carries its own capital, safeguarding and authorization requirements under EU payment legislation.
What does this mean for EU-facing platforms?
The guidance matters most for trading venues that built European operations before MiCA's application date and now hold both a crypto-asset service provider (CASP) authorization under MiCA and, separately, arrangements for fiat handling. Item 70 of the Q&A series functions as part of ESMA's ongoing effort to standardize how national competent authorities interpret the regulation across the 27 member states.
Divergent national interpretation has been a recurring concern since MiCA's stablecoin provisions began applying in June 2024 and its full CASP regime followed in December 2024. Q&A publications from ESMA and the European Banking Authority are the primary instruments regulators use to close interpretive gaps without reopening the legislative text.
The practical effect is a two-license or partner-based structure:
- MiCA CASP authorization for crypto-asset custody, trading and exchange services;
- A licensed payment or e-money arrangement, in-house or through a partner, for euro balances, deposits and withdrawals.
What comes next?
Exchanges serving EU clients without a compliant fiat structure face a compliance decision: secure the payment-side authorization, contract a licensed institution, or restrict euro balance features. Further ESMA Q&A updates are expected as the MiCA regime matures, and firms adjusting their fiat arrangements now will shape how the EU's combined crypto and payment licensing model operates through the transition period that runs to mid-2026.
