California Governor Gavin Newsom on September 27, 2026, signed Assembly Bill 2409, prohibiting the state's public officers and employees from issuing meme coins and barring digital asset platforms from listing certain tokens tied to political figures.
The bill, authored by Assemblymember Avelino Valencia (D-Anaheim), defines a meme coin as a digital asset "marketed based on its association with" internet memes, characters, current events or trends whose value derives primarily from "public interest, speculation or community engagement."
In a follow-up post on X, Newsom stated: "No official should profit off their office." His press office tied the law directly to President Donald Trump's crypto ventures, accusing the administration of "an unprecedented level of corruption."
What does the law actually restrict?
AB 2409 does not impose a blanket prohibition on meme coins. Instead, it bars California public officers and employees from issuing such tokens and restricts digital asset service providers from listing a category of politically linked meme coins.
The platform restriction applies to meme coins issued on or after January 1, 2027, when the asset is offered by or in partnership with a federal, state or local public official.
California's attorney general, district attorneys, city attorneys and county counsels can bring civil actions to enforce the rules, seeking injunctions and disgorgement of funds.
For exchanges and brokers serving California residents, the measure adds another compliance filter on top of federal obligations that already vary by registration status and token classification.
How does AB 2409 connect to Trump's crypto business?
The law arrives amid bipartisan scrutiny in Washington of politicians' involvement in digital assets. Trump and his family have built a substantial crypto business presence. Disclosures have shown more than $1.2 billion in crypto-related earnings for the prior year, including more than $635 million attributed to his Solana-based TRUMP meme coin.
Senator Kirsten Gillibrand (D-NY) renewed calls in July for federal legislation prohibiting politicians and their spouses from issuing or promoting digital assets, including meme coins. Her proposal followed Trump's disclosure.
The issue has also surfaced in negotiations over the federal Clarity Act. A September version included provisions allowing state attorneys general to enforce restrictions on covered officials issuing or sponsoring digital assets. The bill also required divestiture or placement of certain crypto holdings in qualified blind trusts.
The Senate subsequently failed to advance the Clarity Act through a key procedural vote, leaving the federal ethics provisions unresolved.
What else did Newsom sign on digital assets?
Beyond the meme coin prohibition, Newsom signed several other measures addressing crypto. He signed Senate Bill 1208, authored by Senator Tim Grayson (D-Concord), expanding California's money-laundering laws to cover transactions involving digital assets. The measure establishes procedures for law enforcement to seize and forfeit digital assets tied to specified crimes, with provisions for distributing forfeited assets to victims. The digital-asset provisions are scheduled to sunset on January 1, 2032.
In March, Newsom signed an executive order prohibiting California public officials and appointees from using inside information to profit on prediction markets.
In December 2025, the governor launched a website criticizing Trump's pardons of Binance founder Changpeng Zhao, Silk Road creator Ross Ulbricht and BitMEX executives.
